SIJS v. U Visa

SIJS and U Visa can be sought by a non-citizen applicant simultaneously.

  • SIJS provides a potentially faster path to stability.
  • SIJS provides a direct path to lawful permanent resident status, whereas U Visa applicants must apply separately for permanent resident status following U Visa approval.
  • Unlike U Visa, SIJS applicants cannot include family members (i.e., parents and siblings) to derive the immigration status benefit.
  • Both SIJS and U Visa applicants will be screened by USCIS for statutory (i.e., including criminal background checks) and discretionary eligibility.
