Opportunities for Immigration Status

  • Immigration law provides undocumented juveniles with certain pathways to lawful immigration status, including Special Immigrant Juvenile Status (SIJS).
  • Lawful immigration status for a juvenile will bolster the Family Court’s goals of achieving protection and permanency for the child.
  • A minor in a juvenile delinquency proceeding in Family Court CAN get a SIJS special findings order, so long as they can prove the required elements. In re: Mario S., 38 Misc.3d 444 (2012).
