- A change in marital status for certain non-citizen litigants may impact their immigration status, which can leave the non-citizen vulnerable to referral for removal from the United States.
- Divorce, Orders of Protection and Custody have potential immigration consequences.
- Divorce – One parent who had immigration status, is here legally, and began a family, as planned for in the course of the marriage, may now not have legal status to remain after a divorce.
- Custody Orders may impact a non-citizen child’s ability to derive certain immigration benefits, status and/or even the child’s potential right to U.S. citizenship.
- Willful failure to support dependents may prevent individuals from becoming U.S. citizens and may subject them to inadmissibility or deportability.
